Arizona Form 322 allows individual taxpayers to claim a nonrefundable tax credit for qualifying contributions made or fees paid to Arizona public schools and charter schools that provide instruction in kindergarten through grade 12. The credit applies to eligible cash contributions and certain fees paid for qualified activities or programs conducted by the school.

Eligible Schools and Exclusions

  • Eligible Institutions: Arizona public schools and charter schools that provide instruction in grades kindergarten through 12.
  • Qualifying Payments: Cash contributions and certain fees paid for extracurricular activities, character education programs, standardized testing fees, career and technical education programs, and other qualifying purposes authorized by Arizona law.
  • Non-Qualifying Payments: Payments to nongovernmental schools, preschools, community colleges, colleges, universities, or public schools located outside Arizona do not qualify for the credit.
  • Excluded Activities: Fees paid for senior trips or events that are primarily recreational, amusement, or tourist activities do not qualify for the credit.

Credit Limitations and Carryover

  • Annual Credit Limit: The maximum credit that may be established for the taxable year is limited by Arizona law. For tax year 2025, the maximum credit is generally $200 for single individuals, heads of household, and married persons filing separately, and $400 for married persons filing a joint return.
  • Nonrefundable Credit: The credit may reduce Arizona income tax liability to zero but cannot generate a refund by itself.
  • Carryforward: If the allowable credit exceeds the taxpayer's Arizona tax liability for the year, the unused credit may be carried forward for up to five consecutive taxable years.
  • Example: A married couple filing jointly makes a qualifying contribution of $400 and establishes a $400 credit. If only $250 of the credit can be used in the current year because of their Arizona tax liability, the remaining $150 may be carried forward and claimed during the next five taxable years, subject to applicable limitations.
