You do not have to be a U.S. citizen to claim the Earned Income Credit (EIC), but you must meet specific IRS residency requirements.
General Rule
- You must be a U.S. citizen or a resident alien for the entire tax year to claim the EIC.
Exception for Married Filing Jointly
- If you are married filing jointly, you can still qualify if:
- One or both spouses are nonresident aliens, and
- You elect to treat the nonresident alien spouse as a U.S. resident for the entire year under IRC §6013(g) or §6013(h).
Who Does NOT Qualify
- Nonresident aliens who do not make the election to be treated as residents
- Individuals filing married filing separately
- Individuals without a valid Social Security Number (SSN) issued for employment

- Earned income and AGI limits
- Filing status requirements
- Qualifying child rules (if applicable)
