Form 8829 is used to calculate the allowable expenses for business use of a home, specifically for individuals operating a daycare facility from their residence. This form is essential for self-employed taxpayers who use part of their home for daycare services and wish to deduct related business expenses on Schedule C (Form 1040). The form includes specific instructions for daycare providers, including those who use space in their home for both business and nonbusiness purposes.

Eligibility for Daycare Facilities

Individuals who use space in their home on a regular basis for providing daycare services may deduct business expenses even if the same space is used for nonbusiness purposes. To qualify, the taxpayer must have applied for (and not been rejected), been granted (and still have in effect), or be exempt from having a license, certification, registration, or approval as a daycare center or family/group daycare home under state law.

Business Percentage Calculation

For daycare facilities not used exclusively for business, the business percentage is calculated by multiplying line 6 (total hours used for daycare) by line 3 (total area of home used for daycare), then entering the result as a percentage on line 7. For all other cases, the amount from line 3 is entered directly on line 7.

Special Computation for Mixed-Use Daycare Facilities

If the home includes areas used exclusively for business and other areas used partly for business, the standard Part I calculation does not apply. Instead, taxpayers must:

  • Calculate the business percentage of areas used exclusively for business by dividing the exclusive business area by the total home area.
  • Calculate the business percentage of areas used partly for business using Part I’s method, but only include the partly-used area on line 1.
  • Add both percentages and enter the total on line 7.

Attach a detailed computation statement and write "See attached computation" above the percentage on line 7.

  • Line 1 & 2: Use square feet or any reasonable method to determine area. Do not include areas used for inventory costs (these are accounted for on Schedule C, Part III).
  • Line 4: Enter total hours used for daycare. Example: 3,400 hours (3,000 weekday hours + 400 Saturday hours).
  • Line 5: If starting or stopping daycare use in 2025, prorate hours based on available days. Multiply 24 hours by number of available days; do not enter 8,760.
  • Line 7: Business percentage (as described above).

Purpose and Use

Form 8829 is used to determine allowable expenses for business use of a home and any carryover to the next tax year. A separate form must be filed for each home used for business.
