Idaho Residency Status for Individual Income Tax
When filing your Idaho state income tax return, determining your residency status is essential as it affects which form you must use and how your income is taxed. Idaho recognizes three primary residency categories: full-year resident, part-year resident, and nonresident.
Residency Categories
- Full-Year Resident: Individuals who lived in Idaho for the entire tax year. These taxpayers file Form 40 (Individual Income Tax Return).
- Part-Year Resident: Individuals who lived in Idaho for only part of the tax year. These taxpayers file Form 43 (Part-Year Resident and Nonresident Income Tax Return).
- Nonresident: Individuals who did not live in Idaho for any part of the tax year but earned income from Idaho sources. These taxpayers also file Form 43.
How to Report Residency Status
When using OLT (Online Taxes) software to file your Idaho return, you can add your residency status by following these steps:
- From within your tax return (Online), click on State in the left menu (or tap the three dots in the top-right corner for mobile devices).
- Select Start or Revisit Idaho state.
- Under the Personal section, click on Residential Information.
- Select your residency status: Resident, Part-Year Resident, or Nonresident.
- Enter your personal details, filing status, dependents, and any related schedules.
- Review your return in the Tax Summary section before submission.
Special Considerations for Nonresident Aliens
If you or your spouse is a nonresident alien for federal purposes, you are also considered a nonresident for Idaho income tax purposes. You must:
- Select the "Alien Nonresident" box below your address on Form 43.
- Complete lines 64 through 77 as applicable.
- Skip lines 78 through 81.
- Complete the bottom of Form 43 below line 81.
Forms and Instructions
The Idaho State Tax Commission provides detailed instructions for each form. Key forms include:
- Form 40: For full-year residents.
- Form 43: For part-year residents and nonresidents.
- Form ID K-1: For pass-through entities reporting Idaho adjustments and credits to owners.
Note: If you are required to file Form 43 and have an ITIN (Individual Taxpayer Identification Number), you must provide your SSN to the Tax Commission to ensure proper processing of your return.
