The Iowa Claim of Right Tax Credit is available to taxpayers who repay income during the tax year that was previously included in Iowa taxable income and taxed on an earlier Iowa income tax return. This credit is treated as an Other Refundable Credit on the Iowa individual income tax return.
The Iowa Claim of Right Tax Credit follows the federal claim of right provisions under Internal Revenue Code (IRC) Section 1341 and applies when the taxpayer meets the required conditions.
Eligibility for the Claim of Right Tax Credit
A taxpayer may qualify for the Iowa Claim of Right Tax Credit if:
- The taxpayer repaid income during the tax year.
- The repaid income was included in Iowa taxable income and taxed in a prior year.
- The taxpayer qualifies under the claim of right provisions.
- The taxpayer chooses to claim the credit instead of taking an allowable deduction for the repayment.
How the Credit Is Calculated
The Iowa Claim of Right Tax Credit is calculated by determining the reduction in the prior year’s Iowa income tax liability if the repaid income had not been included in that year’s taxable income.
The credit amount generally equals the difference between:
- The prior year’s Iowa tax liability including the repaid income, and
- The recalculated prior year’s Iowa tax liability without the repaid income.
The calculation should be completed according to the Iowa Department of Revenue instructions for the applicable tax year.
Credit or Deduction Election
Taxpayers who qualify for claim of right treatment may generally choose one of the following methods:
- Claim the Iowa Claim of Right Tax Credit, or
- Claim an allowable adjustment for the repayment amount on IA 1040 Schedule 1, if eligible.
A taxpayer cannot claim both the credit and the deduction for the same repayment.
Reporting the Credit
To claim the Iowa Claim of Right Tax Credit:
- Calculate the allowable credit amount using the Iowa Department of Revenue instructions.
- Report the credit as an Other Refundable Credit on Form IA 1040.
- Retain supporting documentation, including prior-year Iowa returns and repayment records.
Iowa does not provide a separate standalone claim of right form. The credit calculation is completed using the instructions provided by the Iowa Department of Revenue.
Important Notes
- The credit applies only to qualifying repayments of income that was previously taxed by Iowa.
- The credit is different from a deduction and must be calculated using the applicable Iowa instructions.
- Taxpayers should keep documentation supporting the repayment and credit calculation.
- The same repayment cannot be used for both the Claim of Right Tax Credit and an Iowa deduction.
