Maryland Preservation & Conservation Easements
Individuals and members of Pass-Through Entities (PTEs) in Maryland may be eligible for a tax credit for conveying a preservation and conservation easement to qualified organizations. These easements help protect open space, natural resources, agriculture, forest land, watersheds, significant ecosystems, viewsheds, or historic properties.
Eligible Organizations
The easement must be conveyed to one of the following entities:
- Maryland Environmental Trust
- Maryland Agricultural Land Preservation Foundation
- Maryland Department of Natural Resources
Key Requirements
- The easement must be perpetual.
- Individuals or PTE members may claim the credit.
- The credit cannot be claimed on both Form 500CR and Form 502CR.
Claiming the Credit
Individuals who qualify should complete the appropriate Maryland tax forms. The credit is reported on specific forms depending on residency status and business structure. For example:
- Residents use Form 502 or Form 502CR.
- Nonresidents use Form 505 or Form 502CR.
