Types of Charitable Contributions
- Charitable Gifts Trust Fund Accounts: Contributions to these accounts, such as the Health Charitable Account or Elementary and Secondary Education Account, are eligible for New York State itemized deductions.
- Voluntary Contributions: Individuals may choose to contribute to specific funds by completing Form IT-227 and submitting it with their income tax return (Form IT-201 or IT-203).
- Partnerships and S Corporations: Shareholders of New York S corporations or partners in partnerships may also contribute, with specific reporting requirements based on their entity’s status.
Reporting Contributions on Tax Forms
Contributions to the Charitable Gifts Trust Fund must be reported on specific lines of New York State and New York City tax forms:
- Form IT-201 (Resident Income Tax Return): Line 47 is used to report contributions for residents.
- Form IT-203 (Nonresident and Part-Year Resident Income Tax Return): Contributions are reported in the New York source income section, with adjustments for special accruals.
- Form IT-360.1 (New York City Resident Income Tax Return): Line 43 includes contributions to Charitable Gifts Trust Fund Accounts as part of New York City adjusted gross income.
- Form IT-196: Line 16b specifically requests contributions to the Charitable Gifts Trust Fund.
Important Notes
- Contributions are deductible only if they are made voluntarily and reported correctly on the appropriate form.
- Nonresidents must report only New York source income, which includes income attributable to business, trade, or property in New York State.
