Oklahoma Net Operating Loss (NOL) is a tax provision that allows individuals, including nonresidents and part-year residents, to carry forward or back losses from a taxable year to offset future or past taxable income. The Oklahoma NOL is determined separately from the federal NOL and is based on Section 172 of the Internal Revenue Code (IRC), as modified by the Oklahoma Income Tax Act. To establish an Oklahoma NOL, the taxpayer must file a return for the loss year. This requirement applies even if there is no federal NOL.

Key Requirements for Establishing an Oklahoma NOL

  • Loss Year Return Filing: A return must be filed for the year in which the loss occurred to establish the NOL. This is required for both resident and nonresident taxpayers.
  • Pass-Through Entities: If the loss is attributable to income or deductions from a pass-through entity (such as a partnership or S corporation), the entity must file any Oklahoma return required under state law. The individual owner computes and claims the Oklahoma net operating loss, if applicable, on their individual Oklahoma income tax return.
  • Separate Calculation: Oklahoma NOL is calculated independently of federal NOL, using Oklahoma-specific rules and adjustments.

Calculating Oklahoma NOL for Nonresidents/Part-Year Residents

  • Nonbusiness Itemized Deductions: All nonbusiness itemized deductions are considered (e.g., $10,000 in example).
  • Nonbusiness Income: Includes nonbusiness capital gains and other nonbusiness income (e.g., $8,000 in example).
  • Lesser of Deductions or Income: Take the lesser of lines 1 and 2 (e.g., $8,000).
  • Net Out-of-State Income: Subtract net out-of-state income (e.g., $3,000) from line 3 (e.g., $5,000 remaining).
  • Business Itemized Deductions: Add business itemized deductions attributable to Oklahoma (e.g., $1,000).
  • Total Oklahoma-Attributable Deductions: Sum of lines 5 and 6 (e.g., $6,000) is entered on Schedule A, line 2a.

Carryover and Reporting

  • Carryovers from previous years must be reported on Form 511, Schedule 511-B, line 4, if the taxpayer has an allowable Oklahoma net operating loss carryover for the tax year.
  • For taxpayers claiming federal depletion carryovers, refer to Schedule 511-B, line 5.
  • Lease bonuses subject to depletion are taken into account in accordance with Oklahoma depletion provisions when determining Oklahoma taxable income and any applicable net operating loss.
