Opportunity Zone Investment Credit
The Opportunity Zone Investment Credit is a tax incentive designed to encourage investment in economically distressed communities designated as Opportunity Zones. This credit is available to individuals who invest in qualified opportunity funds (QOFs) or directly in qualified opportunity zone businesses (QOZBs).
Eligibility and Requirements
- Investment must be made in a Qualified Opportunity Fund (QOF) or a Qualified Opportunity Zone Business (QOZB).
- The investment must be held for at least 5 years to qualify for a partial credit.
- For a 100% credit, the investment must be held for at least 7 years.
- Only individuals who are U.S. taxpayers and meet the income thresholds set by the IRS are eligible.
How to Claim the Credit
To claim the Opportunity Zone Investment Credit, you must file Form IT 1040 (Ohio Individual Income Tax Return) and include the credit on Line 29. The credit is calculated based on the amount invested and the duration of the investment.
Important Notes
- The credit is non-refundable and can only offset Ohio state income tax liability.
- Documentation of the investment, including the QOF or QOZB agreement, must be retained for audit purposes.
- Consult IRS Publication 550 (Investment Income and Expenses) for federal guidance, though Ohio-specific rules apply for state tax purposes.
