When filing your Oregon individual income tax return, you may choose to claim either the Oregon standard deduction or Oregon itemized deductions, whichever results in the greater deduction, provided you are eligible. Your Oregon deduction election is independent of your federal return, meaning you may itemize on your Oregon return even if you claimed the federal standard deduction, or claim the Oregon standard deduction even if you itemized on your federal return.
When You May Need to Itemize
- Married Filing Separately: If you file as married filing separately and your spouse itemizes deductions, your Oregon standard deduction is zero. If you have allowable Oregon itemized deductions, you may itemize instead.
- Certain Non-U.S. Citizens: If you are a non-U.S. citizen without permanent resident status, your Oregon standard deduction is zero. If you have allowable Oregon itemized deductions, you may claim them on Schedule OR-A.
Common Oregon Itemized Deductions
Depending on your circumstances, Oregon itemized deductions may include:
- Medical and dental expenses that exceed the applicable federal adjusted gross income (AGI) limitation, subject to Oregon law.
- State and local taxes allowed under Oregon law.
- Home mortgage interest.
- Charitable contributions.
- Casualty and theft losses, when allowed under Oregon law.
- Other itemized deductions permitted by the Schedule OR-A instructions.
Special Rules
If you claim certain Oregon tax credits based on charitable contributions, such as contributions to the Oregon Cultural Trust, Oregon Production Investment Fund, or University Venture Development Fund, you may be required to add back any charitable contribution deducted on Schedule OR-A that was used to claim the Oregon credit. This prevents receiving both an Oregon tax credit and an Oregon itemized deduction for the same contribution.
