Oregon Residency Filing Status
Oregon residents and part-year residents must determine their correct filing status when completing their Oregon individual income tax return. The Oregon Department of Revenue (DOR) provides guidance on residency status and how it affects tax obligations.
Residency Status Overview
- Resident: Individuals who lived in Oregon for the entire tax year are considered residents and must report all income earned during the year, regardless of where it was earned.
- Part-Year Resident: Individuals who moved to or from Oregon during the tax year must file Form OR-40-NP (Part-Year Resident and Non-resident Income Tax Return) to report income earned in Oregon during the time they were a resident.
- Nonresident: Individuals who did not live in Oregon for the entire tax year but earned income in Oregon must file Form OR-40-NP and report only Oregon-sourced income.
Filing Requirements
For individuals whose filing or marital status has not changed from the previous year, Oregon provides a simplified method to calculate tax liability. Multiply your 2024 total Oregon personal income tax liability by 0.09863. Alternatively, you can use Part A of the Kicker worksheet for this calculation.
Assembling Your Return
When filing, ensure all forms and schedules are from the same 2025 version. For example, if you are including Schedule OR-WFHDC, Schedule OR-A, or Schedule OR-ASC, verify that each page is labeled with “2025” and includes all required pages.
Additional Resources
For detailed guidance on Oregon personal income tax laws and filing requirements, refer to Publication OR-17, which supplements the Oregon income tax instruction booklet and IRS Publication 17. It provides comprehensive information on adjustments, credits, and tax calculations.
