Utah Taxes Paid to Other States: Credit for Tax Paid to Another State
Utah residents who have paid income tax to another state may be eligible for a credit on their Utah state tax return. This credit helps avoid double taxation and is claimed using Form TC-40S, titled "Credit for Tax Paid to Another State."
How to Claim the Credit
- Complete Form TC-40S to claim the credit for taxes paid to another state.
- Enter the name and address of the employer or payer (from Form W-2, Box "c," or Form 1099).
- Indicate if the income and withholding are from a Form 1099 by placing an "X" in the designated box.
- Provide the Social Security number (from W-2 Box "a" or 1099).
- Report the Utah wages or income being reported (from W-2 Box 16 or 1099).
The credit amount cannot exceed the Utah use tax you owe. If you paid sales tax to multiple states, you must complete a Use Tax Worksheet for each state and sum the results for entry on line 31 of Form TC-40.
Important Notes
- The credit is only available for taxes paid to another state, not foreign countries.
- You must attach Form TC-40S to your Utah return (Form TC-40) if claiming this credit.
- For guidance on adding Form TC-40S in OLT’s software, navigate to the State section, select Utah, and follow prompts under the Credits section.
