Massachusetts Health Care Penalty

Massachusetts imposes a health care penalty on individuals who are deemed able to afford health insurance but fail to obtain it. This penalty is applied through the individual’s personal income tax return and is based on the monthly insurance premium for which the individual would have qualified through the Massachusetts Health Connector.

Who is Subject to the Penalty?

  • Individuals who are deemed able to afford health insurance that meets Minimum Creditable Coverage (MCC) and do not obtain it.
  • Those who have access to employer-offered health insurance that meets MCC standards and choose not to enroll.

How is Affordability Determined?

Affordability is determined by comparing your federal adjusted gross income (AGI) to a threshold amount. If your AGI exceeds the threshold, you are considered able to afford coverage and subject to the penalty if you do not obtain insurance.

Exemptions from the Penalty

  • Individuals who have a Certificate of Exemption issued by the Massachusetts Health Connector for the 2025 tax year are exempt from the penalty.
  • Those who cannot afford coverage that meets MCC standards are not subject to the penalty.

How to Report on Your Tax Return

  • Complete Schedule HC, which includes questions about your health insurance status and affordability.
  • If you are subject to the penalty, fill in the "Yes" oval in line 12 of Schedule HC and proceed to the Health Care Penalty Worksheet on page HC-11.
  • If you are exempt, fill in the "Yes" oval in line 9 and enter your certificate number (only numbers, no letters or dashes).

Penalty Calculation

The monthly penalties for 2025 are detailed in Technical Information Release (TIR) 25-1 and are based on the monthly premium for coverage available through the Health Connector. The penalty is applied for each month of noncompliance during the tax year.
