Rhode Island Residency Status
Rhode Island requires taxpayers to determine their residency status when filing state income tax returns. This status determines which form you must file and how your income is taxed.
Residency Categories
- Full-Year Resident: Individuals who lived in Rhode Island for the entire tax year. These taxpayers file Form RI-1040.
- Part-Year Resident: Individuals who lived in Rhode Island for part of the year. These taxpayers file Form RI-1040NR.
- Nonresident: Individuals who did not live in Rhode Island during the tax year but earned income from Rhode Island sources. These taxpayers also file Form RI-1040NR.
How to Determine Your Residency Status
Residency status is determined based on your physical presence and domicile in Rhode Island. The Division of Taxation considers factors such as:
- Length of time spent in Rhode Island
- Place of residence and mailing address
- Registration of vehicles and voter registration
- Family and social ties in the state
Filing the Correct Form
Complete your federal tax return first, as it serves as the basis for your Rhode Island return. The state tax is generally based on your federal adjusted gross income.
- Full-year residents must file Form RI-1040.
- Part-year residents and nonresidents must file Form RI-1040NR.
